2. General Disclaimer and Limitation of Liability

The use of this website and the purchase of GLS/GLP Cargo Loader systems are governed by our complete Terms and Conditions. By accessing this site, you acknowledge and agree to those terms.

Product Use and Safety Disclaimer

  • Product Suitability and Risk: The Customer bears the sole responsibility for determining the suitability of the loader system for their vehicle (van, pick-up), intended load, and operating environment. The Customer must strictly adhere to all operating instructions and safety guidelines provided with the product.

  • Load Limit: Our products have a defined maximum load capacity. Any use of the loader that exceeds this limit, or any form of misuse (including improper assembly or maintenance), is done entirely at the Customer's own risk.

  • Liability Exclusion: Neo-Dyne B.V. accepts no liability for any personal injury, death, property damage, or financial loss arising from the misuse, overloading (loading in excess of the defined load capacity), improper installation, lack of maintenance, or any other deviation from the safe operating procedures of the product.

  • Consequential Damages: As specified in our Terms and Conditions, all liability for consequential damages (such as business interruption, loss of profit, or penalties) is explicitly excluded.

Vehicle Load Capacity & Liability Limitation

  1. The Customer is solely responsible for verifying that the vehicle used in combination with any Neo-Dyne loading system (including but not limited to the GLS and GLP platforms) is technically capable of supporting the combined weight of the loader, cargo, accessories, and any dynamic forces occurring during use or transport. This verification must include, at minimum, the vehicle manufacturer’s stated payload capacity, gross vehicle weight rating (GVWR), gross axle weight ratings (GAWR), suspension limits, and structural load-bearing capability.

  2. Neo-Dyne does not warrant, represent, or guarantee that any vehicle is suitable for use with Neo-Dyne products. Compatibility tools, recommendations, or guidance provided on the website or through company representatives are informational only and do not constitute approval, certification, or a suitability assessment.

  3. Neo-Dyne shall not be liable for any direct, indirect, incidental, consequential, or statutory damages arising from:
    a. the Customer’s failure to confirm the vehicle’s maximum permissible load ratings;
    b. any overloading, improper securing of cargo, or unsafe distribution of weight;
    c. deformation, structural damage, mechanical failure, or performance issues to the vehicle or its components (including but not limited to chassis, suspension, axle, drivetrain, body panels, or doors);
    d. any use of Neo-Dyne products contrary to installation guidelines, manufacturer instructions, regulatory requirements, or industry safety standards.

  4. By purchasing, installing, or using a Neo-Dyne product, the Customer expressly agrees that they bear full responsibility for ensuring compliance with applicable laws, load regulations, and the technical limitations of their vehicle. Neo-Dyne’s liability is strictly limited as permitted by law and shall not exceed the purchase price of the product.

3. Intellectual Property Rights

All content displayed on this website, including product designs, images, text, logos, and technical drawings, is the property of Neo-Dyne B.V.

Crucially, the GLS/GLP Cargo Loader systems sold are subject to design protection and are patent pending. Unauthorized use, reproduction, copying, or reverse-engineering of these products or related intellectual property is strictly prohibited and will be subject to legal action without warning.

4. Transfer of Risk Disclaimer

IMPORTANT NOTICE REGARDING SHIPPING: Notwithstanding the arrangement that Neo-Dyne B.V. covers the freight costs (DAP term), the risk of loss or damage to the product transfers to the Customer immediately when the goods are collected from the Company’s warehouse by the carrier. The Customer is responsible for immediately inspecting the goods upon arrival and noting any transit damage on the carrier's documentation.

5. Dispute Resolution and Governing Jurisdiction

All legal disputes arising out of the use of this website or the purchase of products shall be governed exclusively by Dutch Law. The competent court for resolving such disputes will be the Dutch civil court with jurisdiction in the Company's place of business (Arnhem).
